Guardian Associations and Advocacy Groups

Kentucky Guardianship Association
- The KGA is a non-profit membership organization with the goals of improving adult guardianship in Kentucky.
- They seek to improve guardianship by developing training for persons appointed to serve as guardian for an adult with a disability, training for persons seeking to be appointed as guardian, attorneys representing alleged incapacitated persons and professionals including social workers, psychologists, and medical personnel appointed to interdisciplinary evaluation teams; for the purpose of evaluating the capacity of adults responding to a petition for appointment of a guardian or conservator.
- The KGA was founded on the principle of improving the practice of adult guardianship in KY, by promoting practices that protect the Constitutional rights and autonomy of persons with disabilities.
- Some DAIL staff are members member of the KGA.
Kentucky Protection and Advocacy
Kentucky Protection and Advocacy
- Kentucky Protection and Advocacy is a Division within the Department of Public Advocacy.
- P & A protects and promotes the rights of Kentuckians with disabilities through information and referral, and legal individual and systemic advocacy and education.
Mission:
To protect and promote the rights of Kentuckians with disabilities through legally based individual and systemic advocacy, and education.
Values:
- Kentuckians with disabilities have a right to self determination including, but not limited to, the right to refuse, the right to participate, and the right to choose.
- Kentuckians with disabilities have the same inherent rights as Kentuckians without disabilities.
- Kentuckians with disabilities will live and receive services in integrated and inclusive settings.
- Kentucky Protection and Advocacy values and accepts differences/diversity.

National Guardianship Association
National Guardianship Association
The primary objectives of the NGA are:
- Establishing and promoting nationally recognized standards
- Encouraging the highest levels of integrity and competence though guardianship education.
- Protecting the interests of guardians and people in their care.
- DAIL is a member of the NGA and also adopts and practices their National Guardianship Association Ethical Principles.
State Long Term Care Ombudsman
State Long Term Care Ombudsman
The State Long-Term Care Ombudsman Program, is funded federally by ACL and provides services via a service contract with DAIL. It includes the State LTCO, 15 District Ombudsmen thru the 15 ADDs/AAA’s and a host of volunteers.
Ombudsmen advocate for residents of long-term care facilities at no charge to residents or families.
Their primary responsibilities are:
- Protect the special legal rights of residents.
- Identify, investigate, and resolve residents’ problems and concerns.
- Empower residents to make informed choices.
- Work to enact laws to protect residents and older Kentuckians.
Working Interdisciplinary Network of Guardianship Stakeholders (WINGS)
Working Interdisciplinary Network of Guardianship Stakeholders (WINGS)
- This core group is dedicated to improving the process of guardianship in KY and safeguarding the rights of citizens.
- Educates the public about alternatives to guardianship and supported decision-making and include but not limited to the following: KY District Court, KGA, DAIL, Department for Behavioral Health, Developmental and Intellectual Disabilities, aging and disability networks, Protection and Advocacy, Adult Protective Services, legal, medical, and mental health providers, Long Term Care Ombudsman and more.
What is the Adult Guardianship Program?
Kentucky’s Adult Guardianship Program operates under DAIL. The Adult Guardianship provides case management and support services to individuals with disabilities. These individuals have been court appointed as individuals under guardianship of the state due to an absence of family or others who can provide care.
Area Development Districts (ADD) and Area Agencies on Aging (AAA)
What is an ADD?
Area Development District or ADD is a partnership between counties to provide resources to the local counties and cities withing the ADD region.
ADDs perform many different functions to positively impact quality of life and economic development. ADDs partner with several state and federal agencies and are responsible for obtaining and administering grants for programs.
A volunteer board of directors govern the ADD and are composed of elected officials, community leaders, and business leaders.
In Kentucky there are 15 ADDs to represent all 120 counties.
Where are they located?
The Kentucky Council of Area Development Districts http://www.kcadd.org/ is headquartered in Frankfort with local offices around the state.

What is the relationship between DAIL, ADD, and AAA?
DAIL is designated as the State Unit on Aging by the Administration for Community Living. This federal entity allocates Older Americans Act funding, which provides critical home and community based services to seniors.
DAIL contracts with fifteen (15) Area Development Districts and designates them Area Agencies on Aging (AAA), who then provide services to seniors. State Community Mental Health centers are also located in these regions.
DAIL Organization
The Kentucky Department for Aging and Independent Living oversees administration of statewide programs and services on behalf of Kentucky elders and individuals with disabilities. More information about DAIL including useful and important links can be found through the DAIL Program Agency website.

Assisted Living Community Information and Certification
Assisted Living Community Information and Certification – provides information about required certification by DAIL for assisted living communities in Kentucky.
Caregiver Support Services
Caregiver Support Services – provides information about two service programs available – National Family Caregiver Support Program and Kentucky Family Caregiver Program.
Hart-Supported Living
Hart-Supported Living – provides fund for supports to help Kentuckians with disabilities live in their homes and communities and avoid institutionalization.
Long-Term Care Ombudsman
Long-Term Care Ombudsman – advocates for residents of nursing homes, personal care homes, and family care homes, improving care and encouraging positive change at all levels.
Participant Directed Services
Participant Directed Services – allows people eligible for Medicaid waiver services to choose their own providers for nonmedical waiver services.
Traumatic Brain Injury Trust Fund
Traumatic Brain Injury Trust Fund – has information on the TBI Trust Fund that was established to provide flexible funding and support to those with brain injuries.

What is DAIL?
What is DAIL?
The Kentucky Department for Aging and Independent Living (DAIL) provides state and federal funding and administrative oversight of statewide programs and services for older adults and individuals with disabilities.
To ensure quality of service, as it relates to the health, safety, and welfare of the individuals served; DAIL works in collaboration with Kentucky’s 15 Area Agencies on Aging and Independent Living, Community Mental Health Centers, Centers for Independent Living, other state departments, and a host of service providers and community partners.

What does DAIL do?
DAIL oversees and certifies Assisted Living facilities across the state.
DAIL also administers oversight and funding (state & federal) for the following programs offering disability services: Hart Supportive Living Program, Participant Directed Services via a contract with Medicaid, Brain Injury Trust Fund, State Independent Living Council and the Centers for Accessible Living.
DAIL works to ensure that services provided are person-centered, compliant with state and federal regulations and policies, and support the various aspects of independent living.

Hello! My name is Aida and I am the trainer for your New Employee training. I am so excited that you have joined the guardianship team. Throughout these trainings, I will guide you through the content necessary to know for your role as a guardian. Trainings may include information to read, questions to answer, videos to watch, or more. Handouts are provided for each training. These handouts will provide a space for you to make notes and share important information. You may want to keep these documents in one central location to review at a later date. After a training, you may be asked to share information you have learned, or practice new skills. Don’t worry, when we come to that point I will help provide resources and support to successfully complete these tasks.

Course Description
This session will help trainers strengthen their skills in identifying participant needs and developing impactful training content that leads to desired behavior change. We will walk through a problem-based solution for developing content that incorporates the Knowledge, Skills, and Attitudes staff need to change practice. During this online training session, you will have the opportunity to follow a trainer through the key steps of planning a training session.

- Develop learning objectives using problem-solving approach and the knowledge, skills, attitudes model.
- Develop a training assessment method(s) using knowledge, skills, attitudes model.
- Identify the importance of carefully targeting content during training sessions.

Early Childhood Programs and Families as Partners
The goal of this section is to briefly discuss the role of the early care and education professional when there is a developmental concern that may signal a referral is needed. It is vital that you are familiar with your role, how to engage parents as partners, and what can be done before and after a diagnosis to support families. This section does not provide information on the ‘why’ of referring a child but briefly assists you in becoming familiar with how to speak to families when you have a concern and how you can assist after a child has been diagnosed. Taking the time to build a quality partnership helps to create a foundation that can help families thrive.
