Topic 1: What are our resources?
The foundational resources for Council staff include the DD Act, the Code of Federal Regulations (or CFR for short), and the Notice of Award.
- PL 106-402 DD- Act §126 Federal and Non-Federal Share- Federal law and provides information for the Council grant award on the Federal and non-federal share
- 45 CFR 75 Subpart D – Post federal award requirements §75.306 Cost sharing or matching
- Notice of Award (NOA)- Provides information in the terms and conditions and remarks section, or any other attachments or enclosures.
Non-federal Share and Aggregate
- Councils should have a system in place to look at matching on a project-by-project level to determine the overall match.
- Councils must be able to look at match project by project with the appropriate required match to determine if there is match, overmatch, or undermatch.
- Councils have until the end of each project period to reach match amount.
- Provide detailed documentation for each fiscal year when submitting the annual SF-425.
Basic Rule: Section 126 of the DD Act indicates the Federal Share of the cost of all projects in a State (or Territory) supported by funds from the Council grant award must not be more than 75% of the aggregate (or total) cost of such projects – this is referred to as the “basic rule”.
